Disclaimer / Limitation of Liability

§ 1 Fundamental Limitation of Liability
The operator of this website (hereinafter “Operator”) provides exclusively an information platform on which surgeons (hereinafter “Seal Holders”) are listed who have voluntarily committed to complying with the seal criteria. The Operator is neither a contracting party nor involved in any way in medical treatment, diagnosis, surgical planning, or the performance of any surgical procedure. The Operator acts solely as a neutral listing service.

§ 2 Sole Responsibility of Seal Holders
2.1 The Seal Holders listed on this website act exclusively on their own responsibility and in their capacity as independently practicing medical professionals or as members of a medical institution. The listing on this website does not establish any contractual relationship, employment relationship, relationship of subordination, or any other legally relevant connection between the Operator and the Seal Holders.
2.2 All liability for actions, omissions, decisions, recommendations, diagnoses, or surgical procedures performed by Seal Holders rests exclusively and solely with the respective Seal Holder. This applies without exception to:
∙ Medical malpractice of any kind
∙ Pre-operative, intra-operative, and post-operative complications
∙ Incorrect or incomplete patient informed consent
∙ Breach of professional medical duty of care
∙ Non-fulfillment or defective fulfillment of the seal criteria
∙ Damage to the life, body, health, and property of patients
∙ Direct and indirect damages of any kind and any extent
∙ Claims by third parties, including relatives of patients

§ 3 No Guarantee or Warranty by the Operator
3.1 The Operator provides no guarantee, warranty, or assurance that the listed Seal Holders actually, continuously, or fully comply with the seal criteria. The award of the seal is based exclusively on the voluntary declaration of commitment made by the Seal Holders themselves.
3.2 The Operator conducts no medical, professional, or substantive review of the activities of Seal Holders. No ongoing monitoring takes place. The listing does not constitute a recommendation, a certification in the legal sense, or a quality attestation by the Operator.
3.3 In the event of misrepresentation, deception, or violation of the seal criteria by a Seal Holder, that Seal Holder shall be solely and fully liable to the Operator and to any injured third parties.

§ 4 Indemnification
4.1 By accepting inclusion in the listing, each Seal Holder expressly agrees to indemnify, defend, and hold harmless the Operator from and against any and all claims, demands, actions, costs (including reasonable attorneys’ fees), damages, and liabilities arising from their activities as a medical professional, from any violation of the seal criteria, or from any other circumstances related to their person or professional conduct.
4.2 This indemnification obligation applies with respect to claims brought by patients, relatives, health insurers, authorities, and other third parties, regardless of whether the claim is civil, criminal, or administrative in nature.

§ 5 Limitation of the Operator’s Liability
5.1 The liability of the Operator is excluded to the fullest extent permitted by applicable law. This applies in particular to:
∙ Damages arising from engaging the services of a listed Seal Holder
∙ Damages caused by incorrect, incomplete, or outdated information on the website
∙ Damages resulting from technical failures, data loss, or interruptions in website availability
∙ Indirect damages, consequential damages, loss of profit, and non-material damages of any kind
5.2 The Operator’s liability may not be excluded only in cases mandated by applicable law (e.g., in cases of intentional misconduct or gross negligence on the part of the Operator, or in cases of injury to life, body, or health caused directly by the Operator).

§ 6 External Links
To the extent that this website contains links to external pages of Seal Holders, the Operator has no influence over their content. Responsibility for linked pages lies exclusively with the respective Seal Holder.

§ 7 Severability Clause
Should any provision of this disclaimer be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.

§ 8 Governing Law and Jurisdiction
This disclaimer is governed by the laws of the Federal Republic of Germany. The place of jurisdiction, to the extent permitted by law, is the registered seat of the Operator.
